Delaware to Launch Adult-Use Marijuana Sales August 1, 2025
Legal cannabis is coming to Delaware. On August 1, 2025, the First State will officially begin adult-use marijuana sales—a long-anticipated milestone in the state’s evolving approach to cannabis policy.
According to the Office of the Marijuana Commissioner (OMC), all medical marijuana conversion licensees are cleared to begin recreational sales starting August 1. This marks a historic shift, as Delaware joins the growing number of states with legal, regulated adult-use cannabis markets.

Building a Safe, Equitable Cannabis Market
Newly appointed Marijuana Commissioner Joshua Sanderlin emphasized the importance of collaboration in getting Delaware ready for launch:
“The start of legal adult-use marijuana sales reflects the tireless efforts of our regulatory team and our strong partnerships with state agencies, industry stakeholders, and community leaders,” said Sanderlin. “Our focus is on building a safe, equitable, and accountable marijuana market that delivers real benefits to Delawareans.”
The Office of the Marijuana Commissioner continues to issue conditional licenses to previously selected applicants, allowing them to prepare for future operations.
The Road to Legalization
Delaware legalized adult-use cannabis in 2023, creating a regulatory framework that includes:
-
Cultivators
-
Manufacturers
-
Retailers
-
Testing laboratories
-
Social equity licensing preferences
This framework is designed to ensure public health, safety, and equitable participation, particularly for communities disproportionately impacted by prior cannabis laws.
After a detailed public input process, the final regulations were adopted in September 2024, setting clear standards for licensing and operations across the new industry.
Governor Meyer: A Step Forward
Governor Matt Meyer praised the launch of Delaware’s adult-use program, calling it a win for public health, economic opportunity, and social justice:
“This new industry will generate critical revenue to strengthen our schools, infrastructure, and public health systems,” said Meyer. “It also gives us a powerful tool to invest in the communities most impacted by the war on drugs. I’m proud we’re moving quickly and thoughtfully to build a cannabis market that reflects our values.”
Supporting Social Equity
Two key laws passed in 2024—House Bill 334 and House Bill 408—enhanced the state’s cannabis program:
-
HB 334: Expanded the scope of the adult-use program
-
HB 408: Enabled existing medical marijuana operators to apply for conversion licenses
Conversion licenses were costly—$200,000 for cultivators and $100,000 for manufacturers or retailers—but generated $4 million in funding for social equity grants, supporting new entrepreneurs from impacted communities.
Application Overload
During the license application window (Aug 19–Sept 30, 2024), OMC received 1,269 paid applications, far exceeding expectations. In December 2024, OMC awarded 125 licenses through a public lottery process.
What’s Next?
As Delaware’s cannabis industry rolls out, OMC has committed to keeping the public informed and maintaining a fair, transparent, and compliant system. More updates are expected as new businesses open and more licensees come online.
