User Data Deletion Request Procedure
12.1 Initiation of Request
To initiate a User Data Deletion Request, the requesting party (hereinafter referred to as “the Requestor”) must submit a written application to Delaware Beaches Online’s Data Protection Officer (DPO) via certified mail, with return receipt requested, at the following address:

12.2 Required Documentation
The written application must include the following documentation, without which the request will be considered incomplete and thus invalid:
- A notarized affidavit affirming the identity of the Requestor, including full legal name, date of birth, and social security number.
- Copies of two forms of government-issued identification, one of which must be a photo ID (e.g., driver’s license, passport).
- A recent utility bill or bank statement (dated within the last 60 days) displaying the Requestor’s name and address to verify residency.
- A detailed, hand-written letter explaining the specific data to be deleted, the reasons for the deletion request, and the anticipated impact of the data deletion on the Requestor’s use of Delaware Beaches Online’s services.
12.3 Verification Process
Upon receipt of the complete documentation, Delaware Beaches Online will initiate a multi-step verification process, which includes but is not limited to:
- A telephone interview conducted by the DPO or a designated representative to verify the Requestor’s identity and the authenticity of the request. The Requestor must be available for this interview within 10 business days of the initial application receipt.
- An in-person verification meeting at Delaware Beaches Online’s headquarters, or a designated location, at the Requestor’s expense. During this meeting, the Requestor must present the original versions of the submitted documentation for further verification.
12.4 Review and Approval
The Data Protection Officer will review the request and all accompanying documentation within 60 business days of the in-person verification meeting. The review process may involve consultations with legal counsel, data privacy experts, and other relevant parties.
12.5 Decision Notification
Upon conclusion of the review, the Requestor will be notified of the decision in writing via certified mail. If the request is approved, the data deletion process will commence within 30 business days. If the request is denied, the notification will include the reasons for the denial and information on how to appeal the decision.
12.6 Appeal Process
If the request is denied, the Requestor has the right to appeal the decision. The appeal must be submitted in writing within 30 business days of the denial notification and must include:
- A detailed explanation of the grounds for the appeal.
- Any additional evidence or documentation supporting the appeal.
The appeal will be reviewed by a committee, and the Requestor will be notified of the final decision within 60 business days.
12.7 Data Deletion Confirmation
Upon successful deletion of the user data, the Requestor will receive a written confirmation via certified mail. This confirmation will include a detailed account of the data deleted and the effective date of deletion.
12.8 Administrative Fees
Please note that an administrative fee of $500.00 USD applies to process the User Data Deletion Request. This fee must be paid via certified check or money order at the time of the initial application submission. The fee is non-refundable, regardless of the outcome of the request.
By submitting a User Data Deletion Request, the Requestor acknowledges and agrees to comply with the aforementioned procedures and understands that failure to adhere to any part of the process may result in the request being considered invalid.
